Metropolitan Jewish Health System Foundation, doing business as MJHS Foundation (“MJHS Foundation,” “we,” “our,” or “us”), is committed to protecting the privacy of donors, volunteers, event attendees, and other visitors to our website. This Privacy Statement explains what information we collect through mjhsfoundation.org (the “Site”), how we use and protect it, the limited circumstances in which we share it, and the choices and rights available to you.

MJHS Foundation is a 501(c)(3) tax-exempt charitable organization and is affiliated with a HIPAA-covered health care entity. Please read Section 15 carefully for how this Privacy Statement relates to protected health information (PHI) handled by MJHS and its affiliates under HIPAA.


1. Scope of This Privacy Statement

This Privacy Statement applies only to information collected, used, and disclosed through mjhsfoundation.org. It does not apply to:

  • Protected health information (PHI) held by MJHS or any MJHS-affiliated covered entity, which is governed by the separate MJHS Notice of Privacy Practices issued under HIPAA;
  • Information collected on other websites operated by MJHS or its affiliates (each of which may have its own privacy notice); or
  • Information collected offline (for example, in person, by phone, or by mail), except as noted in Section 10.

2. Information We Collect

a. Information You Provide Directly

When you interact with the Site, you may choose to provide personal information through the following features:

  • Online donations (name, postal address, email, phone, employer, donation amount, tribute/memorial details, and payment information processed by our payment processor as described below)
  • Contact and inquiry forms (name, contact information, and the contents of your message)
  • Event information requests and registrations (name, contact information, registration details, and any optional information you choose to share)
  • Volunteer sign-ups (name, contact information, areas of interest, and any background information you choose to provide)
  • Planned giving inquiries (name, contact information, and the nature of your interest)
  • Email newsletter sign-ups

Personal information is never collected from you without your knowledge.

b. Information Collected Automatically

When you visit the Site, certain limited technical information is collected automatically through cookies and similar technologies, as described in Section 6. This may include IP address, browser type and version, device type, referring URL, pages viewed, and approximate location derived from your IP address.

Because MJHS Foundation is affiliated with a HIPAA-covered entity, we use Freshpaint as a privacy- and HIPAA-aware data governance layer between the Site and analytics/advertising tools (including Google Analytics 4, Google Ads, and Meta) so that any information that could constitute protected health information is filtered before it reaches third-party platforms.

c. Payment Information

Online donations are processed by Blackbaud Merchant Services. Your full payment card number, security code, and bank account details are submitted directly to the payment processor and are not stored on MJHS Foundation servers. We receive only confirmation details (such as donation amount, date, last four digits of the card, and transaction ID).


3. How We Use Your Information

We use the information we collect to:

  • Process donations, issue tax receipts, and acknowledge gifts;
  • Communicate with you about your donation, registration, inquiry, or volunteer activity;
  • Send newsletters, event invitations, stewardship updates, and other communications you have requested, or that relate to your existing relationship with us;
  • Plan, host, and follow up on events;
  • Operate and improve the Site, troubleshoot technical issues, and protect against fraud and misuse;
  • Comply with legal, tax, audit, and regulatory obligations, including those of the Internal Revenue Service and the New York State Attorney General’s Charities Bureau.

4. How We Share Your Information

MJHS Foundation does not sell, rent, trade, or exchange donor lists or personal information with any other organization for that organization’s own marketing or fundraising purposes.

We share personal information only in the limited circumstances described below.

a. Service Providers

We share information with vendors that perform services on our behalf under contracts that require them to safeguard it and use it only for the services they provide to us. These include:

  • Blackbaud Merchant Services — payment processing
  • Blackbaud Raiser’s Edge NXT — donor and constituent relationship management
  • Blackbaud email tools and Constant Contact — email communications
  • Liquid Web — HIPAA-compliant website hosting
  • WordPress — website content management software
  • Freshpaint — privacy/compliance layer for analytics and advertising signals
  • Google (Google Analytics 4, Google Ads) and Meta — analytics and advertising, mediated through Freshpaint

b. Affiliates

We may share information with MJHS and its affiliated organizations as necessary to operate the Foundation, recognize donors, coordinate care or services you have requested, and conduct activities consistent with our charitable mission.

c. Legal and Safety

We may disclose information when required by law, subpoena, court order, or government request; to enforce our policies; to investigate potential violations; or to protect the rights, property, or safety of MJHS Foundation, our donors, our beneficiaries, or others.

d. Business Transitions

In the event of a merger, consolidation, dissolution, or other corporate transaction involving MJHS Foundation, information may be transferred consistent with applicable law and the purposes described in this Privacy Statement.


5. Cookies and Tracking Technologies

The Site uses cookies and similar technologies to operate, remember your preferences, measure traffic, and support fundraising and outreach. Categories used include:

  • Strictly necessary cookies — required for the Site to function (for example, security and donation form functionality).
  • Performance/analytics cookies — help us understand how visitors use the Site, delivered through Freshpaint to Google Analytics 4.
  • Advertising cookies — used by Google Ads and Meta, again routed through Freshpaint so that protected information is not transmitted.

A cookie consent banner is presented to first-time visitors, allowing you to accept, reject, or manage non-essential cookies. You can also adjust cookie settings in your browser at any time.

Global Privacy Control (GPC). Our Site is configured to recognize and honor GPC signals sent by your browser as a request to opt out of “sale” or “sharing” of personal information for cross-context behavioral advertising.


6. Email Communications

We may send transactional emails (donation receipts, event confirmations, responses to inquiries) and, where you have signed up or have an existing relationship with us, fundraising and stewardship communications. Every marketing email includes an unsubscribe link. You may also opt out at any time by contacting info@mjhsfoundation.org.

Please note that ordinary email is not a fully secure means of communication. Do not include sensitive health, financial, or other confidential information in email correspondence with MJHS Foundation.


7. Links to Other Websites

The Site may contain links to websites that are not owned or controlled by MJHS Foundation. We provide these links for convenience and information only. A link to a non-MJHS site does not imply endorsement, and we are not responsible for the privacy practices, content, or accuracy of information on other sites. We encourage you to review the privacy policy of any site you visit.


8. Our Commitment to Donor Privacy

MJHS Foundation strives to operate in accordance with the AFP Donor Bill of Rights developed by the Association of Fundraising Professionals, the Council for Advancement and Support of Education (CASE), the Giving Institute, and the Giving USA Foundation. Among other things, we commit that:

  • Donor information is handled with respect and confidentiality, to the extent provided by law.
  • We do not sell, rent, trade, or exchange donor lists or donor information with other organizations.
  • Donors may request that their gifts be acknowledged anonymously and that their names be excluded from public donor recognition (such as annual reports, donor walls, and event listings);
  • Donors may request removal from any mailing or solicitation list at any time.
  • Donors may ask questions about how their information is used and expect prompt, truthful answers.

9. Your Choices and Rights

Regardless of where you live, you may:

  • Unsubscribe from marketing emails using the link in any message or by contacting info@mjhsfoundation.org;
  • Request anonymous recognition of your gift or exclusion from public donor listings;
  • Ask us to access, correct, or delete personal information we hold about you, subject to legal, tax, audit, and recordkeeping obligations that may require us to retain certain information (see Section 11);
  • Adjust cookie preferences through our cookie banner or your browser settings.

State Privacy Rights

Although MJHS Foundation, as a nonprofit organization, may be exempt from some state consumer privacy laws (including, in many cases, the California Consumer Privacy Act/California Privacy Rights Act), we extend the substance of these rights as a matter of policy. Residents of any U.S. state may submit a request using the contact information in Section 14, and we will respond consistent with applicable law.


10. Children’s Privacy

The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us at info@mjhsfoundation.org, and we will take appropriate steps to delete it.


11. How Long We Keep Information

Consistent with standard nonprofit recordkeeping practices, we retain donor and constituent records indefinitely for stewardship, donor recognition, tax substantiation, audit, and legal compliance purposes. Non-donor inquiry data, event attendance records, volunteer records, and technical/analytics data are retained only as long as reasonably necessary for the purposes for which they were collected or as required by law.


12. Data Security

MJHS Foundation maintains reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, alteration, disclosure, or destruction, consistent with the Stop Hacks and Improve Electronic Data Security (SHIELD) Act. These measures include:

  • HIPAA-compliant website hosting through Liquid Web;
  • Payment card handling through PCI-compliant processors (Blackbaud Merchant Services), so that full card numbers are not stored on Foundation systems;
  • Freshpaint is a compliance gateway for analytics and advertising.
  • Access controls, staff training, and vendor due diligence for systems that handle constituent information.

No method of transmitting or storing data over the internet is 100% secure, and we cannot guarantee absolute security. If you have reason to believe that your interaction with the Site is no longer secure, please notify us immediately at the contact information below.


13. Relationship to the HIPAA Notice of Privacy Practices

MJHS Foundation is affiliated with a HIPAA-covered health care entity. This Privacy Statement does not govern protected health information (PHI). PHI held by MJHS or its affiliated covered entity is governed by the separate MJHS Notice of Privacy Practices, which describes your rights under HIPAA and how PHI may be used and disclosed for treatment, payment, health care operations, fundraising consistent with HIPAA, and other purposes permitted by law. The Notice of Privacy Practices is available at mjhs.org and on request.

If you make a donation, attend an event, or otherwise interact with the Foundation in a capacity that does not involve your care, the information you provide is treated under this Privacy Statement and not as PHI.


14. Changes to This Privacy Statement

MJHS Foundation may update this Privacy Statement from time to time to reflect changes in our practices, technology, legal requirements, or for other operational reasons. When we make a material change, we will update the “Last Updated” date above and, where appropriate, provide additional notice (for example, a banner on the Site or an email to recent donors). We encourage you to review this Privacy Statement periodically.
